TheSoftware, on its own initiative and for marketing purposes, may conduct various drawings and advantageous offers of a tangible and intangible nature, including prizes or awards. Each participant must familiarize themselves with the terms and conditions of the draw, provide the necessary data to acquire the status of a participant, and follow the rules. In case of providing inaccurate information that caused refusal to participate or led to exclusion from the draw, the responsibility lies with the person who provided the data.

OBTAINING A CONDITIONAL LICENSE

INDEMNIFICATION

You understand that there is liability for violations and for accidental or intentional damage, which entails indemnification, and you agree to it. You will also hold TheSoftware, each of its parents, subsidiaries and affiliates, and each of their respective members, officers, directors, employees, agents, co-branders and/or other partners harmless from any claim, expense (including reasonable attorneys' fees), loss, suit, action, cost, demand, and/or judgment made by any third party due to or arising out of: (a) your conduct of the Website, use of the Privacy Police, Content, and/or participation in any Sweepstakes; (b) your breach of the applicable Agreements; and/or (c) any violation by you of any rights of any other person or entity. The provisions of this clause shall inure to the benefit of TheSoftware, as well as to the benefit of the listed entities and departments of the company, including shareholders, licensors, suppliers and other individuals and entities included in this clause. Each of these individuals and entities may seek legal action to enforce these provisions against you.

TheSoftware does not control the activities of other parties' sites, resources and platforms. CHOICE OF LAW/VENUE

In the event of a conflict or dispute arising out of or relating to the Agreement, the laws of Estonia (without regard to its conflict of laws principles) shall govern and categorize the dispute. Any award rendered by the arbitrator shall be deemed final for the parties, and judgment thereon may be entered in any court of competent jurisdiction. Nothing herein shall be construed as a means or method to prevent any party from seeking injunctive relief to protect its rights before the arbitration award is rendered. To the extent permitted by law, you agree that you will not file, join, or participate in any class action with respect to any claim, dispute, or controversy you may have against The Software and each of their legal representatives, affiliates, subsidiaries, parents, agencies, and their respective members, officers, directors, employees, and agents. You consent to injunctive relief to stop such action or to exclude you as a party to the action.
